vaguelytoasted's commissions

Henceforth, "I" refers to myself, VaguelyToasted, the artist, seller and provider of services.
"You" refers to the customer and buyer.
"Services" refers to commissions or artwork made complete or partially "on-demand", individual or as a group.By purchasing my services, you are agreeing to the following conditions. Please read this entirely and carefully. I reserve the right to refuse any service at any time. If there are any questions or concerns, feel free to contact me.

1, I will request that full payment be given before the commission’s start. If necessary or for large orders, a payment plan can implemented.2, All payments should be made via invoice method. When an agreed price is reached, I will request an email to send an invoice through Paypal. Completed pieces will also be sent to this email unless otherwise requested by you by date of completion.3, By sending payment, you are asserting that you are the paypal account owner, your account is in good standing, and you are incompliance with Paypal's Terms of Service. I will not issue refunds for unauthorized account use after work has been completed.4, Commissions will only be started upon receipt either a complete payment or first payment in a payment plan.

payment

4a, For amounts greater than $100 USD, payment plans are available upon request. Payment plans are determined based on the scope of the project, estimated timeframe, and history with myself or other artists. Payment plans must be discussed beforehand and are considered final upon receipt of first payment.4b, I reserve the right to pause projects that require multiple payments until additional payments are received. This will be communicated to the buyer in advance.

5, Payments are due within 72 hours of the invoice being sent unless otherwise agreed in advance. I reserve the right to end a project due to late payment.

refunds

1, You may request a full refund at any time before a project is started.

1a, Be aware that I typically start a project almost immediately after receiving payment or first part of payment plan if applicable.

2, Once I start sketching your commission, I cannot refund for the full amount.

2a, Once a commission is started, the amount refunded will be determined by the amount of work completed. For example, you requested a full body, colored and shaded piece, and I have only finished the sketch, you will be charged for a finished sketch and the remaining money will be refunded.2b, In the event I must end a project for whatever reason, I reserve the right to choose to provide a full refund and keep any completed work OR provide a partial refund and all completed work if admissible.

3, I am not responsible for any fees that may be associate with a refund through Paypal.4, Once the work is completed I cannot refund it. If you have multiple pieces commissioned, there may be a chance for a partial refund.

artist

1, By commissioning me, you’re purchasing my artist labor only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

1a, I reserve the right to publish the completed piece and any in progress images to any of my personal social media pages unless agreed upon in advance.1b, I will respect your request to not publicly post your commission when agreed upon in advance.

2, You retain all Intellectual or Trademarked Property rights of any characters/creatures/figures/etc. featured in the image.3, I reserve the right to reject commission proposals for any reason at any point.4, I reserve the right to modify and resell any rejected sketches/designs/line art (or any other phase of artwork) such as a YCH or otherwise

commissioner

1, You may upload and share in progress and completed works purchased by you to your site as long as it is credited and linked back to any of my media pages.2, Once a piece is completed, you may use it for any personal at your discretion including, but not limited to icons, signatures, layouts, wallpapers, themes and personal site display.3, You retain the rights to the IP.4, You may not claim the work to be your own, edit or set it up for redistribution. You may not use it for any external projects, commercial or non-commercial unless agreed upon.5, You may not resell the piece.

procedure

Preface: You understand that VaguelyToasted is not working with only your priorities in mind. She will do her best to communicate necessary adjustments to completion dates with as much advanced notice as is possible.-- -- -- -- --1, After payment is received I immediately begin sketching the commission.2, I do not accept "description only" commissions. You must have at least one visual reference.3, After the sketch is completed, I will send it to you for confirmation and complete the work after unless I have questions about the design.

3a, I will not move to the next stage of work without receiving written approval from you.

4, I allow for some changes to be requested free of charge:Henceforth, "small change" refers to less than 50% of the piece. "Large change" refers to 50% or more of the piece and "complete redo" refers to the entire piece being redone.In the price you are allotted 1 large change and 1 complete redo with unlimited small changes. If there becomes a large number of requested small changes (exceeding 5) I may ask for a small fee for further adjustments.

4a, Once you have approved a stage and I move on to the next, I reserve the right to charge additional fees for changes made to a previous stage even if all free changes have not be used. For example, If you approve the pose in the sketch phase, but request it to be changed in the flat color stage, there will be an additional charge even if not all allotted free changes have been used.4b, I reserve the right to end a commission due to excessive changes.4c, Please be clear and concise in your description of a change. You can use other works and photos you like as references for the adjustments.

5, You are allowed to request a WIP at any time6, I will reference and color pick from any reference given. If I am unable to get a good color pick from your reference image, I will try my best to match it.

6a, If you request a change to a color I color picked from your provided reference, please provide either a hexacode or a new visual reference I can color pick from.6b, digital references without shading are highly preferred

7, A full size, non-watermarked image will be given upon completion. It is necessary that you use a watermark/resized version of the image before sharing publicly.8, Upon completion, final receipt of payment, and final approval, I will email you a copy of the piece as a flattened PNG unless another file type is requested in advance.
